Synagogue: Court rules on engineer’s case Nov. 2 …… PUNCH

A Federal High Court in Lagos has fixed November 2, 2015 for ruling on preliminary objections to a rights enforcement suit by one of the two structural engineers who built the collapsed Synagogue Church of All Nations’ building, Mr. Oladele Ogundeji.

Ogundeji sued the Lagos State Commissioner of Police, the Council for the Regulation of Engineering in Nigeria, the Attorney General of Lagos State and Mr. Oyetade Komolafe, the coroner who recommended him for criminal negligence over the death of the 116 persons who perished in the collapsed SCOAN building.

Ogundeji is seeking an order of perpetual injunction restraining the Commissioner of Police in Lagos State from arresting, detaining, investigating or prosecuting him based on Komolafe’s verdict and recommendations.

He also wants an order of perpetual injunction restraining the Lagos State Attorney General or any officer under his authority from initiating or commencing criminal proceedings against him based on the verdict of the coroner.

At the Monday’s proceedings, the engineer’s lawyer, Mr. Olalekan Ojo, said the engineer considered the coroner’s verdict a nullity and maintained that there was no basis for the police to invite, arrest or investigate him.

Ojo said, “The fulcrum of the applicant’s case is that he was not charged with any offence before the coroner; he merely appeared as a witness and the coroner went on to indict him of criminal negligence and it is a nullity.”

  1. Hogwash! Who does the lawyer think he is talking to? Morons? So a witness cannot become an accused? Is that the law?
