The law in Nigeria is that an arrested person shall not be handcuffed, or otherwise bound or be subjected to unnecessary restraint except in the following instances:
1️⃣ By order of the court; or
2️⃣ When there is a reasonable apprehension of violence, or
3️⃣. When there is a reasonable apprehension of an attempt to escape or;
4️⃣ The restraint is necessary for the safety of the person arrested; or
5️⃣. The person had resisted arrest; or
6️⃣. The person had escaped from lawful custody;
𝙏𝙝𝙚 𝙐𝙣𝙘𝙤𝙢𝙛𝙤𝙧𝙩𝙖𝙗𝙡𝙚 𝙌𝙪𝙚𝙨𝙩𝙞𝙤𝙣𝙨: Which one applies to Dele Farotimi (a lawyer) in the present instance, to warrant his being handcuffed the way he was in the full glare of the public? Or, is there more to this than meets the eye? Is he no longer presumed innocent according to law?
Thank you.
